Commissioner Agreement; Artists Promise:

 

I, the Commissioner, do hereby promise to...

1. READ YOUR TERMS OF SERVICE AND ABIDE BY THEM. Not all artists have a TOS, but if they do, it is your job to read them and understand the conditions under which they work. Not only does this show to them that you respect their time and talent, but this is also helpful to answer basic questions that are traditionally answered somewhere in here. Like any sort of agreement between two people, these rules are to ensure fairness for both and happiness on the part of the artist.

2. MAKE SURE THAT I HAVE PERUSED ENOUGH OF YOUR WORK TO GET AN APPROPRIATE SAMPLING. I have not just 'come in off the street'. I have taken a minimum of 5 minutes to examine your style and determine that you are suitable for my idea. I do not expect you to be a mind reader, and if the finished product does not meet my expectations, I will not hold you responsible for following any and all directives I may or may not have provided. I have taken the time to know this is not your speciality and will allow for a reasonable deviation. I will include ALL relevant details at first contact, and will request changes according to your TOS.

2b. If your commission is a gift, I am not responsible if the recipient is unsatisfied. By purchasing a commission on a gift basis as a surprise, you accept the consequences for the results, not the artist.

3. I WILL PROVIDE DETAILS. If I do not give all important or forgotten details within 48 hours of payment, I will not complain when the artist is unable to include them in the image. If I do not give any details, I give the artist has creative license over the image ( which is also acceptable if I want to see the artist's own interpretation of an idea.)

4. I WILL HAVE THE MONEY WHEN AGREED. By commissioning you, I will have the money or access to funds either immediately or will have discussed a payment time with the artist within a week of the initial commission request. If I am paying for a large image or many images, I will either pay at once, or discuss and agree upon a payment plan with the artist.

5. ANY SPECIAL CONDITIONS WILL BE DISCUSSED BEFORE THE COMMISSION IS PLACED. If I ask you for a birthday picture, I will tell you when it is needed by. If I fail to mention this information at the time of contact, I forfeit the right to complain when my request is not honored through no fault of the artist. If I want it kept private, I will ask beforehand.

6. RIGHT OF CANCELLATION. If the need comes up to cancel a placed commission, I will provide as much notice as possible. I will agree to any payment forfeited due to work already done.

7. PESTERING ARTISTS. I will not be impatient because I wish to see my image. I realize that commissions are completed on a first-come-first-serve basis, and I will wait for images before mine to be completed. I will check the queue first if I want to see where my commission lies on the queue. I will wait a reasonable amount of time before checking in, in the event the artist does not present their own queue. Should more than two months pass without contact, the artist forfeits their right to patience.

8. REFUNDS. I may only request a refund before work has been started and I will do so respectfully. Any demands for a refund, especially in violation of the TOS, will be ignored.

9. RESPOND. Even if I do not commission you, I will respond to your note and tell you. I will not ignore your message, and will politely tell you that I am unable to commission you at the time.




I, the artist, do hereby promise to...

1. DISCLOSE ANY SPECIAL CONDITIONS NOT MENTIONED IN MY TOS AT TIME OF OPENING. I will inform my commissioners of any possible delays or limits in characters or backgrounds in my journal. In the event that I am unable to determine my availability, I will inform commissioners of possible cancellation.

2. PROVIDE ART STATUS AND SKETCHES BY REQUEST ONLY. A queue is provided that clearly states my current commissions in the order I will be completing them. I will not provide constant updates on the status of work, as I feel it slows down the process, but you are welcome to ask if you are concerned. If you want to see sketches of your piece before I begin to work digitally, you need to ask within 24 hours of payment.

3. KEEP DRAMA OUT OF IT. If you are running a professional endeavour through your FA, you will not use it as a personal soapbox for your beliefs and/or political statements. This is unprofessional and for your personal account.

4. ONLY ACCEPT IDEAS I AM COMFORTABLE WITH. An artist may refuse an idea they do not believe they can do well, or if given free reign and are unable to think of a pose are allowed to cancel without penalty, within reason.

5. RETAIN ALL RIGHTS TO MY WORK. You may repost a commission if credit is given in the description, but only pieces that you have commissioned. You may not alter a commission, whether it was for you or another commissioner.

6. BEGIN WORK AFTER PAYMENT. If you haven't paid me, I will not begin the commission.
